»Plea Bargaining in Austrian Criminal Proceedings - The Power of the Factual« The current Austrian Code of Criminal Procedure does not allow the plea bargain as an instrument of completion. The Austrian supreme court has in 2004 ruled out plea bargaining. Nevertheless, plea bargains nowadays seem to be commonplace in the daily dealings of criminal justice. The central question of this research is therefore to explore how Austria should be proceeding in the face of these circumstances.
